Commercial Real Estate

Commercial real estate is a major focus for MPS Law, one that occupies a large share of our professional staff and resources. Indeed, our capabilities exceed those of many national and international firms in our market, and have earned us a reputation as one of the top real estate law firms in the Chicago area. We serve as outside counsel to financial institutions, real estate developers, and local, national and global businesses engaged in corporate, industrial, and retail development as well as financing, leasing, and investment. Because our practice is commercial in nature, we do not typically engage in consumer transactions, except on a programmatic basis for our commercial clients. We offer a wide range of commercial real estate capabilities, with expertise in the following areas:

  • Improved and unimproved land acquisition and disposition
  • Land use and entitlement, including annexation, zoning, and planned development approvals for complex and mixed-use industrial, office, retail, recreational, and residential developments and subdivisions
  • Special financing and development transactions, including tax increment financing, special service areas, business development districts, sales and use tax incentives, industrial revenue bonds, and other public/private incentives for commercial, industrial, retail, recreational, and residential real estate uses and development
  • Acquisition, development, and construction financing, mezzanine financing, and investment joint ventures and equity investment
  • Commercial office, industrial, and retail leasing and development
  • Construction contracts and sub-contracts for general construction, management, design-build, and build-to-suit projects
  • Litigation, arbitration, and mediation of cases and disputes involving all aspects of real estate development and finance, including foreclosure actions, landlord-tenant actions, land use, eminent domain, defense of owners in completed projects, and intergovernmental challenges and actions pertaining to tax increment finance and other incentive districts and approvals
